Liability
The liability of Siembrala Academia de Danza is limited to the terms and conditions of the program regarding the provision and quality of the services. Siembrala Academia de Danza acts as an intermediary and coordinator between tourism service operators and other service or product providers.
Accordingly, Siembrala Academia de Danza shall not be held responsible for:
• Situations caused by force majeure, unforeseen events, natural phenomena, or criminal acts. However, as part of the policy of Siembrala Academia de Danza, we are committed to assisting in the search for solutions to any issue users may face, to the extent circumstances allow.
• Extra expenses resulting from changes, delays, or cancellations of services, strikes, riots, earthquakes, or any other force majeure events; as well as for any loss, accident, or irregularity affecting users or their belongings when such events are caused by third parties and are therefore beyond the control of Siembrala Academia de Danza, its staff, and affiliates.
• Expenses related to the loss of or damage to the user’s property or documents.
• Air transportation services; therefore, Siembrala Academia de Danza is not responsible for the consequences of delays or unforeseen changes in flight schedules arranged by airlines, nor for the user’s rights and procedures to request refunds arising from such events.
• Legal matters or other inconveniences in which a user may become involved if they are required to leave a plan, activity, or experience due to moral, disciplinary, or legal misconduct, as well as any personal expenses incurred as a result.
• Baggage and its contents, or any personal item carried by the user, as these are the sole responsibility of the user.
• Users of services provided by Siembrala Academia de Danza must present any documentation required by the relevant authorities (national ID for adults, and birth certificate or identity card for minors). Failure to comply with this requirement releases Siembrala Academia de Danza from any financial claim arising from incidents caused by such omission in connection with the execution of the plan.
• Refunds in cases where the user is unable to attend the scheduled experience and did not provide timely notice.
Service Conduct and Operational Changes
Siembrala Academia de Danza reserves the right to interrupt the service if ethical and moral standards necessary for the proper development of each activity are not met. Therefore, users in a state of intoxication and/or under the influence of psychoactive substances, or in any condition that threatens their own safety or that of other users or service providers, will not be admitted.
Siembrala Academia de Danza also reserves the right to make changes to itineraries, experience dates, classes, transportation providers, and other services necessary to ensure the successful delivery of its services.
Responsible Tourism – Warnings
Ethical Policy
Siembrala Academia de Danza rejects the Commercial Sexual Exploitation of Children and Adolescents and is committed to prevention and reporting both inside and outside the venues where the different activities offered take place. Therefore, all of our team members, collaborators, and partners are committed to the dissemination and enforcement of Laws 1336 and 1329 of 2009.
Warning
Please be advised that the Colombian Penal Code, in Articles 208 to 218, establishes that anyone who engages in sexual intercourse with a person under fourteen (14) years of age, performs other sexual acts with or in the presence of such a person, induces them, uses virtual means, coerces any person into prostitution or sexual exploitation, or photographs, films, sells, buys, exhibits, or in any way commercializes pornographic material, by any means of communication, for the purpose of obtaining sexual contact with minors under eighteen (18) years of age or offering sexual services involving them, shall incur prison sentences ranging from 2 to 10 years and fines of fifty (50) to one thousand (1000) monthly legal minimum wages.
Likewise, Siembrala Academia de Danza complies with Colombian labor legislation, including international treaties ratified by the Colombian government on this matter. Accordingly, it supports the free choice of employment, does not engage in forced labor or discriminatory practices, and rejects any practice related to child labor.
Cancellations and Refunds
If the user is unable to attend or wishes to cancel the immersion experience, they must request cancellation x time in advance, and the following options will be offered:
• Reschedule the experience at no additional cost, provided it takes place within the same calendar year.
• If the user chooses not to reschedule and instead requests a refund, 90% of the amount paid will be refunded, considering that planning and logistical costs have already been incurred and must be covered. Payment platform commission fees shall be borne by the client.
• If, for any reason, the user is unable to attend or cancels with less than 24 hours’ notice, there will be no refunds or reimbursements.
• If Siembrala Academia de Danza is forced to cancel before the date of the experience, the registered user shall be entitled to a 100% refund if rescheduling is not possible. Likewise, if the experience is interrupted due to events constituting force majeure, Siembrala Academia de Danza shall refund users for the value of the services not enjoyed.
• Any applicable refunds shall be processed within 30 calendar days following the request. However, if the process takes longer for reasons beyond the control of Siembrala Academia de Danza, no interest shall be recognized on the amounts to be refunded. Likewise, if Siembrala Academia de Danza incurs any cost in processing the refund, such cost shall be deducted from the user.
Habeas Data / Personal Data Protection
Both Siembrala Academia de Danza and its users shall use any information obtained from the other in strict compliance with the provisions of Law 1266 of 2008 and Law 1581 of 2012 regarding habeas data and personal data processing, respectively, as well as any other rules that supplement, amend, or complement them.
Likewise, any user who purchases a plan or experience with Siembrala Academia de Danza authorizes it to use the information and documentation provided. In doing so, Siembrala Academia de Danza shall act as the party responsible for the processing of any personal data it collects and therefore undertakes to comply with all legal requirements regarding personal data under applicable laws, as well as to maintain the security and confidentiality of such personal data.
The personal information provided to Siembrala Academia de Danza shall be used only for the purposes authorized by you and is stored on our servers, with all physical, technical, and administrative security measures in place to prevent loss, alteration, fraudulent use, or improper access.
